FSSAI Issues Directions Regarding Compliance of Organic Food Regulation :


Through a notification dated 29 June 2018, the FSSAI has issued directions regarding Compliance of Food Safety and Standards (Organic Food) Regulation, 2017 which have been published in the Official Gazette of India dated 29th Dec. 2017. According to the 29 December 2017 notification all Food Business Operators were required to ensure compliance of their existing and new organic products by 1 July 2018 with all the provisions of these regulations. Also, FBOs were to comply with various regulations notified under Food Safety and Standards Act, 2006.
  • However, the FSSAI has received various representations from stakeholders and after review of the preparedness of the implementation of the above regulations, they have decided to permit the use of non-detachable stickers with respect to the FSSAI Organic logo which is required as per the regulation of 30 September 2018.
  • Food Business Operators that manufacture or processor handle Organic Foods shall have to obtain a license under the Food Safety and Standards Act, 2006 or get the organic food endorsed in their existing license through the FLRS up to 30 September 2018
  • Further, for the purpose of sub-regulation (2) of the regulation 4 of the Organic Regulations, it is clarified that the small producer or producer organisation may be the same as for ‘petty food manufacturer’ under the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulation, 2011 which in other words means businesses with an annual turnover not exceeding Rs.12 lakhs per annum.
Regulation 4 of the Food Safety and Standards (Organic Food) Regulation, 2017 as mentioned above is as follows
Applicability of the systems: (1) The organic food offered or promoted for sale shall also comply with all the applicable provisions of one of the following systems, namely:—
(i) National Programme for Organic Production (NPOP);
(ii) Participatory Guarantee System for India (PGS-India).
(iii) Any other system or standards as may be notified by the Food Authority from time to time.
(2) The Organic food which is marketed through direct sales by the small original producer or producer organization, as determined by the Food Authority from time to time, to the end consumer shall be exempted from the provisions of the systems referred in sub-regulation (1)mentioned above.

Food Safety and Standards (Organic Foods) Regulations, 2017 is coming in to force from 1st April, 2019,

Processed milk samples fail to meet quality norm

To check this, the regulator has directed the organised dairy sector to strictly complying with the quality norms and put in place 'testing and inspection' at entire value chain by January 1, 2020     Processed milk, including of major brands, have failed to meet the prescribed quality norm in 37.7 per cent of the total samples tested, according to an FSSAI study. In safety parameters too, 10.4 per cent of the processed milk samples were non-compliant, much higher than 4.8 per cent in raw milk. Adulteration was found in only 12 of the total samples surveyed with maximum reported in Telangana, followed by Madhya Pradesh and Kerala, the study said. The FSSAI study collected a total 6,432 milk samples from 1,103 towns and cities between May and October 2018 in all states and union territories.
